Does my employer get to know my diagnosis?
Last updated September 3, 2026.
No - HIPAA bars your doctor from sharing your diagnosis without your written permission, and notes are built accordingly: dates evaluated, work capacity, restrictions - not the reason. Employers can legitimately hold the fitness-for-work facts and, for FMLA or accommodations, certification of a qualifying condition - functional impact, not necessarily the named diagnosis. Watch the leak points: occupational health works for the employer, insurance claims are de-identified in employer reports, and self-disclosure sits outside HIPAA. Share the minimum through HR; "I prefer to keep the diagnosis private" is a complete sentence.
What to do
- Route through HR, not your manager. Need-to-know stays narrow.
- Give dates and restrictions only. That is the legitimate ask.
- Ask occupational health what gets passed on. Their rules differ from your doctor's.
- Know self-disclosure is unprotected. HIPAA does not cover what you say yourself.
